Be More than a Customer - Be a Client
Understanding the difference between being a Customer and being a Client is the key to protection and empowerment for the Buyer.
Whom the Agent is representing will determine the “customer versus client” status for the Buyer and consequently the level of responsibility and the extent of the service owed by the Agent to the Buyer.
To the Listing Agent, the Buyer is a mere CUSTOMER. The Listing Agent owes some duties to the Buyer (such as the duty to answer questions honestly and treat the buyer fairly), however throughout all the agent's dealings with the Buyer CUSTOMER, the Listing Agent will be representing the seller and promoting the best interests of the Seller over those of the Buyer.
In contrast, a Real Estate Agent who represents the Buyer has the Buyer as A CLIENT. A Buyer’s Agent owes no allegiance whatsoever to the Seller. A Buyer’s Agent must instead promote the best interest of the Buyer throughout all dealings with the Buyer and other parties to
the transaction.
The duties which an Agent owes the Buyer CLIENT which are not owed to the Buyer CUSTOMER include loyalty and confidentiality and the duty to exercise utmost care, competence and integrity on behalf of the Buyer.
What this means (among other things) is that the Buyer Agent must be motivated to obtain the best possible price and can be made liable to the Buyer if, after the purchase has been completed, there are any unpleasant surprises for the Buyer that due diligence on the part of the Agent would have uncovered. A Buyer who is not a CLIENT does not have these protections.
